Case Dismissed
On February 5, 2022, client was a passenger in a
Ford Expedition traveling eastbound on Interstate
80. A Wyoming Highway Patrol Trooper saw the
vehicle from the westbound lanes, crossed over the
median and began traveling at a high rate of speed
to catch up to the Expedition. Although the
Trooper had not witnessed any traffic violations,
he reached speeds of almost 100 mph, without his
lights or sirens, to catch up the vehicle. Once he
caught up to the vehicle, the Trooper "camped out"
in the laft lane, pacing his vehicle less than one
second off the rear bumper of the Expedition. As
the Expedition approached a semi in the right
lane, the Trooper remained "camped out" in the
left lane, creating the Following Too Close
traffic violation for which the Trooper pulled
over the Expedition. Mr. Bennett challenged the
reasonableness of the Trooper creating the
circumstances of the traffic violation in light of
the Trooper having not witnessed any other traffic
violations.
