Attorney Biography
Gilbert Garcia has lived in Montgomery County for the past 30 years and has been fighting possession of marijuana, vape pen, wax, and dab charges for many years.
Gilbert attended Central Catholic High School. He went on to earn an Army ROTC scholarship and attended the University of Notre Dame, where he received his Bachelor of Arts degree in Government in 1975. After graduation, Gilbert headed back to Texas to attend the University of Texas Law School and received his Doctor of Jurisprudence in 1978.
Gilbert worked as an Assistant District Attorney in Bastrop, Texas where he was responsible for prosecuting offenses of all types. As a lead trial prosecutor, Gilbert gained valuable trial skills in prosecuting serious offenses including murder, DWI and drug cases.
After he received his Texas State Bar license in 1978, Gilbert was commissioned as a Captain in the United States Army where he served as legal counsel in the Judge Advocate General (JAG) Corps. Gilbert proudly served his country as a prosecutor and defense attorney in the United States Army. Gilbert was assigned to Fort Sill Oklahoma with Temporary Duties from Texas to Panama. As a member of the JAG Corps, Gilbert gained valuable trial experience which included Drug, Sex, Robbery and other major criminal cases.
Then in 1983, Gilbert moved to Montgomery County and worked as an Assistant County Attorney for Civil Affairs and later as Civil Section Chief. He founded Garcia & Garcia, Attorneys at Law, P.C. in 1983 and The Gilbert G. Garcia Law Firm in 2008. He has been located on the courthouse square for the last 29 years.

Gilbert is a member of the State Bar of Texas (Criminal Justice Section Member & Individual Rights & Responsibility Section Member), Texas Board of Legal Specialization – Criminal Law, Texas Criminal Defense Lawyers Association, National Association of Criminal Defense Lawyers, College of the State Bar of Texas, The National College for DUI Defense, Inc., and The National Organization for the Reform of Marijuana Laws (NORML). Gilbert is also a member and past president of the Montgomery County Bar Association and the Montgomery County Criminal Defense Lawyers Association. He is a proud member of The Woodlands Bar Association, Texas Exes and the Alliance of Board Certified Attorneys.
