Attorney Biography
John Floyd has been a trial lawyer since 1990, trying 67 jury trials (business/professional negligence) to verdict. In addition, he has tried numerous cases before State regulatory boards and judges throughout Tennessee. He is certified as a Civil Trial Specialist by the National Board of Trial Advocacy and Medical Malpractice Specialist by the American Board of Professional Liability Attorneys.
Mr. Floyd’s practice focuses on business and corporate litigation and the representation of professionals in negligence cases throughout Tennessee and the United States. He has represented clients in various types of business/commercial and personal injury cases, including wrongful death claims, as well as cases involving the Lanham Act, civil conspiracy, intellectual property, partnership dissolution, products liability, and derivative shareholder actions. Commercial and Business litigation cases have included the successful representation of Fox Broadcasting Company in a "reverse passing" off case involving NASCAR, Atlanta Motor Speedway and Speedway Motors Sports arising out of the televised 2001 Atlanta Motor Speedway 500. Furthermore, Mr. Floyd has represented clients in legal matters involving off-label use of drug devices and pharmaceuticals and Medicare and Medicaid billing/reimbursement issues. He also has experience in fidelity law, director’s and officers’ liability, and contract law.
Mr. Floyd received his Bachelor of Arts degree, with honors, from the University of Tennessee in 1987. He subsequently received his Doctor of Jurisprudence degree in 1990 from the University of Tennessee, College of Law, where he was a member of the National Trial Team. He is a member of the Nashville, Tennessee, and American Bar Associations, the Tennessee Defense Lawyers Association, and the Defense Research Institute (DRI), where he is a member of the Medical Professional Liability Committee. Mr. Floyd is also a member of the Federation of Defense & Corporate Counsel (FDCC), which is composed of leaders in the legal community who are committed to promoting knowledge, fellowship, and professionalism in the justice system.
Mr. Floyd has received several honorary distinctions in his career, including nomination and recognition in the national publications of Mid-South Super Lawyers ® (Business & Corporate Litigation) every year since 2006, which recognizes attorneys that have achieved substantial success in their career. He has also received the highest attorney rating (AV) from Martindale-Hubbell, which is "a testament to the fact that lawyer’s peers rank him at the highest level of professional excellence."
Mr. Floyd is admitted to practice before all State Trial and Appellate Courts; the United States Supreme Court; United States District Court for the Middle, Eastern, and Western Districts of Tennessee; United States Court of Appeals for the Sixth Circuit; and the Supreme Court of Tennessee.
