Attorney Biography
Mr. Covert is an accomplished trial attorney who is devoted to representing cannabis patients in legal matters. He travels the state of Michigan protecting the rights of patients and has made appearences on behalf of clients in 47 out of Michigan’s 83 counties.
Mr. Covert has served as lead attorney on several high profile cannabis cases, including the 2013 Free Bree CPS Case, where he arranged the return of infant baby Bree to her parents after CPS removed her due to the parents’ medical use of cannabis. Mr. Covert also obtained what is believed to be the first section 8 dismissal under the MMMA in Oakland County.
Mr. Covert is also the attorney responsible for the Court of Appeals Decisionwhich made the improper transport statue (MCL 750.474) no longer applicable for otherwise law abiding card holding patients. This ruling was celebrated by patients and had an effect statewide because it saves several MMMA patients from an arrest every day.
Mr. Covert has obtained not guilty verdicts after a trial in cases ranging from minor in possession of alcohol to severe drug and weapon felonies.
Under the MMMA he has obtained section 8 affirmative defense dismissals in Alpena, Gratiot, Ingham and Kent counties. Josh has also fought for the right to present the section 8 affirmative defense in Berrien, Saginaw and Wayne Counties.
Mr. Covert reguarly speaks at many events hosted by organizations such as the Marijuana Law Section of the Michigan State Bar, The High Times Cannabis Cup, Dark Horse Brewery and Michigan Moms United.
some acknowledgments for his achievements as a cannabis attorney, including the 2016 Crystal Trichome Award for Best Law Firm as well as a scholarship in 2015 to attend the NORML Legal Committee Conference in Key West, FL.
Mr. Covert sees himself as an advocate for Marijuana policy reform. He currently sits on the board of directors for MILegalize, a political organization working toward the responsible recreational adult use of Marijuana. Mr. Covert also attends marijuana events throughout the state including the High Times Cannabis Cup and Hash Bash.
When Mr. Covert is not working for his clients or toward Marijuana policy reform, he spends his time creating a wide range of robot-themed art that the cannabis community celebrates.
