2011 -  Ineffective assistance of counsel and Wrongful convicted by Public Defender Melinda Ryals

I am a Florida resident **Georgia is paying for a roof over my brother's head, 3 meals a day, medical, schooling, clothing******  Ineffective assistance of counsel and Wrongful convicted.  GUILTY: LIFE sentence with Parole. (Dec 2012) Georgia State, John Hites GDC 1000694062 The reason for my correspondence is to raise a concern I have in the handling of Case: 11-CR57 for John Thurston Hites Jr., vs the State of Georgia. I need someone to please listen to my concerns as John Hites has exhausted all avenues for potential release. I strongly feel there was an injustice action with the case that saddens and upsets me with regards to our judicial system. I strongly feel my brother has been sentenced for a crime he did not commit. The main focus on on the ineffective assistance of counsel 4 of areas mentioned below.  Knowing I would have had a different outcome if it wasn't for Melinda Ryals' inadequate representation.     At Motion-For-A-New Trial, (12mo after Trial 12/2012) Original, Public Defender, Melinda Ryals was subpoenaed by the State and she tells Judge Howard E McClain (Also the Trail judge) this was a Self-Defense case. She never said the word Self-Defense at Trial for the Jury to have knowledge of the situation.   Randy Simmons, her Investigator was called on behalf of the defense side and he said, "He did not investigate the case because he was not instructed to do so", by Melidna Ryals the Public Defender who was representing my brother.  During the trial, GBI (Georgia Bureau of Investigators) 2 agents said on the stand, "There was NO blood found on the defendant and there was NO indication he changed his clothing".  Defendant shoe prints were found at the scene so that shows at least the shoes were at the scene.  Blood is everywhere and NOT on the defendant,....Innocent until proven GUILTY is not in the agenda.
