Case Results of S. Joshua Macktaz

Providence Police are called to an accident scene at a Providence gas station. A witness reports that while pumping gas she sees Client’s vehicle, with it being driven on the bare rim, drive over the curb and strike her vehicle. She quickly turns off the pump and calls police. Police observe Client to be extremely unsteady on his feet and speaking in incoherent sentences. Police suspect he may be under the influence of drugs, so they summon a Drug Recognition Expert (DRE) to the scene. After a battery of DRE tests, the Police determine Client is unfit to operate a motor vehicle and arrest him. Client is taken to the hospital where he consents to a blood draw.

Cumberland Police are called to a serious accident. Client’s vehicle had swerved off of the road and hit a house. Client had a strong smell of alcohol, bloodshot and watery eyes, and speech so slurred the Police could not understand what she was saying. No field sobriety tests were performed, however Client did consent to a blood draw at the hospital.

Woonsocket police receive a hang-up 911 call from Client’s house. Upon arrival they find Client’s wife outside the house crying and very upset. She tells police that Client came home drunk and they got into a fight. During the fight, Client pushed her to the ground and began to break the furniture in the house.
