One Person's Opinion
From what I understand, the justice system in Upper Sandusky Ohio is nothing short of laughable. She
charged me a $100 consultation fee for which I was promised as much time with her as I needed to
which I received a total of about 8 whole minutes over the course of 3 days, I was hung up on, and I
was lied to three times. When I told my regular attorney, he was absolutely disgusted.
I was told there was a $100 consultation fee to which I agreed...didn't bat an eye and had them
schedule a phone consultation because I am an hour and a half away. After explaining my situation to
whoever answered the phone, she told me I wouldn't be charged a fee and she will call me at our
scheduled time.
I was called almost 10 minutes late for our consultation, by someone in the office, and was told
again, that I needed to pay the $100 fee, asked if I had my card ready. I got out my wallet without
hesitation, paid it, and got about 4 minutes of Kelly's time...but only after they confirmed my card
had cleared. I have yet to receive my invoice/receipt for my payment which has obviously cleared.
I spoke with Kelly only 2 times and both times, when I said things that she, as an attorney should
already rightfully know, she would hang up the phone really quickly, said she was going to call the
court and she would call me right back. But she would never call right back.
She informed me that the Prosecuting Attorney and Municipal Judge would never drop my ticket because
of their bias in favor of cops and I won't win (which violates the Ohio State and Federal Judiciary
Code of Ethics). She then told me a story about how a police office was on the stand and was not
certified to use his radar detector, hadn't been trained to use it, amongst other things, and the
judge still found her client guilty.
I told her that I have a Constitutional Right to a fair and unbiased trial as written in the Federal
and State Judicial Code of Ethics - a Trooper that falsified information on my ticket two times
would be considered "discredited" yes? She again, hung up the phone quickly to call the court and
said I will call you right back. Guess who didn't call me back until it was too late to file for a
continuance.
Only after the deadline to file for a continuance passed, she had *her office* call me to say
"Kelly wanted me to call you and let you know that after further review, she doesn't feel like she
can give your case the time that it deserves and the attention that it deserves."
If she would have taken my case, she can file for a continuance to have the time to go over all of
the details - even I know this. This sort of behavior can be seen as poor business practice or even
cowardice under certain circumstances.
The State Trooper that pulled me over inflated the charges of my fine on two accounts and including
falsifying the speed that he said he supposedly "locked me in at." - The 1 mile an hour difference
upped my fine an additional $25.
She told me the prosecutor dropped my fine to a first offense rather than the second offense charged
on my ticket. The officer told my my fine was higher because it was my second offense, which it was
not. I have not been told what the price difference is but the dollars are sure adding up. Imagine
that happening to just 2 people a week 52 weeks a year...by 1 Officer of the Law. Multiply that by
however many officers of the law get away with it county/statewide. That is a lot of theft by the
people sworn to uphold the law, protect us/our Constitutional Rights, AND live by a Judicial Code of
Ethics.
I was told by another Attorney that it is highly likely that the State Trooper's audio from the time
of the incident would not be available...it would be lost, or wasn't recording, and if he is
questioned he will likely lie under oath. His statement corroborates Kelly's.
I have trial next week, which I am told I will likely pay absurdly ridiculous court costs - to a
back-alley Municipal Building in a tiny town, with apparently no money and a seemingly corrupt
Judicial System (that has yet to be determined).
I will wait to review the ethics of the Judiciary in place in Upper Sandusky and allow them the
opportunity to provide a fair and unbiased trial. Innocent until proven guilty, yes?
As it stands, if what Kelly has told me is true about the culture of the Ohio State Troopers and/or
Police Officers, Judge, and Prosecutor, then something should be done to put a stop to the unethical
culture of stealing constituants money via unlawfully inflated traffic fines and not offering them a
fair trial.
I heard "Just pay the ticket" no less than three times. That sort of attitude can be seen as a
promotion of this unethical culture. If I would have just paid the $200 ticket without question and
a portion of the fine was dismissed (unknowingly to me) because it wasn't my second offense, would
they have sent me my money back? I'm skeptical.
