The defendant, Matthew Clark, was charged with
felony criminal threatening after an incident in
which the complainant secretly recorded a
conversation. Defense counsel, Attorney Leif A.
Becker of Becker Legal, PLLC, filed a motion to
suppress the recording on grounds that it violated
New Hampshire’s wiretapping statute. The trial
court denied the motion, and the defense pursued
an interlocutory appeal to the New Hampshire
Supreme Court. The appeal centered on whether
suppression was required for recordings made in
violation of the misdemeanor subsection of the
wiretapping statute.
