The trial court denied the father's legitimation.
Afterwards, the Father disclosed that he and
mother had executed an administrative legitimation
in 2016. Once she obtained proof, Maria filed in
the trial court to set aside the order. This was
denied and Maria filed a discretionary application
with the Court of Appeals. The discretionary
application was approved and an appeal followed.
The Court of Appeals found that the trial court
improperly denied the motion to set aside the
final order. Additionally, the Court of Appeals
noted that administrative legitimations executed
prior to 2016 were still valid under Georgia law.
