False arrest is a common law tort brought in state or federal court by a person who alleges that he was held in custody without probable cause or other legal authority.

Police officers and other law enforcement officers are often shielded from false abuse lawsuits through a legal process known as qualified immunity.

Qualified immunity does not cover the most egregious cases in which the law enforcement officers have violated "clearly established law."

Because of the protections provided through qualified immunity, most false arrest claims involve lawsuits against private security firms and loss prevention officers employed by retail establishments.
