The Diocese terminated Mr. Cerbone as a result of
his reporting sexual misconduct between student
athletes. The Diocese fired Mr. Cerbone and
blamed the sexual misconduct on him in a statement
to various media outlets. At trial, the evidence
showed that not only was Mr. Cerbone not
responsible for the students at the time the
misconduct occurred, there was also a history of
sexual hazing that predated his tenure.
